Question:

I was hurt in a car accident and keep getting calls from the adjuster at the other driver’s insurance company. Should I return the adjuster’s call? Or should I not be talking to them?

Answer:

No! Don’t talk to the other driver’s adjuster.

If you were in a car accident and not at fault, the other driver’s insurance company will likely call you, trying to get to you before you lawyer-up. They know that once you hire an attorney, they can’t speak with you, so they move quickly to get to you.

Do not take calls from the other driver’s insurance adjuster. You should instead first speak to a personal injury attorney. Get the attorney’s opinion on whether you need a lawyer. If yes, the lawyer you hire will speak to the defendant’s insurance adjuster on your behalf. If the attorney advises you that you don’t need a lawyer, the attorney can also give you advice on how to handle conversations with the other side.

WHY YOU SHOULDN’T SPEAK TO THE OTHER DRIVER’S ADJUSTER

The other driver’s insurance adjuster will take advantage of the fact that you are not represented by a lawyer. They will ask questions that we don’t want you to answer because your answers could be used against you later. Your telephone statement is being recorded by the adjuster. It’s not that we think you’ll lie to the adjuster. It’s that the adjuster will pin you down on things we don’t want you pinned down on. Your recorded statement could come back to haunt you and torpedo your injury claim.

WHY YOU SHOULDN’T SPEAK TO THE OTHER DRIVER’S ADJUSTER

Bottom line: don’t talk to the other driver’s adjuster. Call a car accident lawyer first to find out if you need a lawyer.
