Should I talk to the other driver's insurance?

Answer:

No!

The other driver's insurance company will often call you repeatedly soon after an accident. They ARE NOT calling you because:

  • They care about how you are doing.
  • They want to help you get medical treatment.
  • They want to offer to pay for your medical bills.

The only reason they are calling you is to extract information which they can use against you in order to deny your claim or pay you as little as possible. They want to speak to you before you hire an attorney because once you retain legal counsel, the insurance company is not legally allowed to speak to you (without your lawyer's permission).

You should only speak with the other driver's insurance company if you are going to go through them on your property damage claim. If that is the case, only speak to them about your vehicle: where it is, where you want to get it repaired, scheduling inspection, etc. DO NOT talk to them about how the accident happened or your injuries.
